Puppy Purchase Agreement
By purchasing a Scottish Terrier puppy from Scottish Terrier Breeder California ("Breeder"), you ("Buyer") agree to the following terms and conditions. This agreement is designed to ensure the health, safety, and well-being of our puppies.
1. Deposit and Payment Terms
1.1 Deposit
- A non-refundable deposit of $500 is required to reserve a puppy
- The deposit secures your place on the waiting list or reserves a specific puppy
- Deposits are non-refundable but may be transferred to a future litter under certain circumstances
- Deposits must be paid via cash, certified check, or bank transfer
1.2 Final Payment
- The balance of the purchase price is due before the puppy leaves our care
- Payment must be made in cash, certified check, or bank transfer
- Personal checks must clear 10 business days before puppy pickup
- The puppy will not be released until payment is received in full
1.3 Pricing
- Puppy prices are subject to change
- The price quoted at the time of deposit is the price you will pay
- Delivery fees are separate and not included in the puppy price
2. Puppy Selection and Pickup
2.1 Selection Process
- Puppy selection is typically done in the order deposits were received
- We reserve the right to make recommendations based on temperament matching
- We may retain pick of the litter for our breeding program
- Selection typically occurs when puppies are 6-7 weeks old
2.2 Pickup/Delivery
- Puppies are ready to go home at 8-10 weeks of age
- Buyer must pick up or arrange delivery within 7 days of the agreed-upon date
- If Buyer fails to pick up the puppy within this timeframe, a boarding fee of $25/day will apply

3. Health Guarantee
All puppies come with our comprehensive health guarantee. Please review our Health Guarantee page for complete details. Key points include:
- 72-hour initial health guarantee
- 2-year genetic health guarantee
- Buyer must have puppy examined by a veterinarian within 72 hours
- Buyer must maintain proper veterinary care to keep guarantee valid
4. Buyer Responsibilities
4.1 Veterinary Care
- Buyer agrees to provide proper veterinary care throughout the dog's life
- Buyer must follow recommended vaccination and preventive care schedules
- Buyer must provide monthly heartworm and flea/tick prevention
- Buyer must have puppy examined by a veterinarian within 72 hours of delivery
4.2 Spay/Neuter Agreement (Pet Puppies)
- Pet puppies must be spayed or neutered by 18 months of age
- Proof of spay/neuter must be provided to receive full AKC registration
- Breeding rights are not included with pet puppy purchases
- Unauthorized breeding will result in legal action and financial penalties
4.3 Proper Care
- Buyer agrees to provide proper nutrition, exercise, and socialization
- Buyer agrees to keep the dog as a family pet in a safe, loving environment
- Buyer agrees not to chain, neglect, or abuse the dog
- Buyer agrees to comply with all local laws and regulations
5. Breeder's Rights and Responsibilities
5.1 What We Provide
- A healthy, well-socialized puppy
- Complete health records and veterinary health certificate
- Current vaccinations and deworming
- Microchip (registered to Buyer)
- AKC registration papers
- Puppy starter kit with food, toys, and comfort items
- Lifetime breeder support
5.2 Right of First Refusal
- If Buyer can no longer keep the dog for any reason, Breeder must be contacted first
- Breeder has the right of first refusal to take the dog back
- Buyer agrees never to sell, give away, or surrender the dog to a shelter or rescue without first offering the dog back to Breeder
- Breeder will take the dog back at any time, for any reason, at no cost to Buyer
6. Breeding Rights
- Unless specifically stated in writing, all puppies are sold as pets with limited AKC registration
- Breeding rights are available for an additional fee and only to approved homes
- Breeding rights require a separate contract and additional health testing commitments
- Unauthorized breeding of a pet puppy is a breach of this agreement
7. Cancellation and Refund Policy
7.1 Buyer Cancellation
- Deposits are non-refundable
- Deposits may be transferred to a future litter at Breeder's discretion
- If Buyer cancels after final payment, no refund will be provided
7.2 Breeder Cancellation
- If Breeder is unable to provide a puppy due to circumstances beyond our control (small litter, health issues, etc.), Buyer may choose a full refund or transfer to the next available litter
- Breeder reserves the right to refuse sale to any buyer at any time
8. Liability and Indemnification
- Buyer assumes all responsibility and liability for the dog after taking possession
- Buyer agrees to indemnify and hold harmless Breeder from any claims, damages, or expenses arising from the dog's actions
- Breeder is not responsible for any injuries or damages caused by the dog after delivery
- Buyer is responsible for complying with all local laws, including licensing and vaccination requirements
9. Dispute Resolution
- Any disputes arising from this agreement will be resolved through mediation before pursuing legal action
- If legal action is necessary, it will be conducted in the state of California
- The prevailing party in any legal action will be entitled to reasonable attorney's fees
10. Miscellaneous
10.1 Entire Agreement
This agreement, along with our Health Guarantee and Privacy Policy, constitutes the entire agreement between Buyer and Breeder.
10.2 Modifications
This agreement may only be modified in writing and signed by both parties.
10.3 Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions will remain in full force and effect.
10.4 Communication
- Buyer agrees to keep Breeder updated with current contact information
- Buyer agrees to respond to Breeder's inquiries about the dog's well-being
- Buyer agrees to provide updates and photos periodically
11. Acknowledgment
By purchasing a puppy from Scottish Terrier Breeder California, Buyer acknowledges that they have:
- Read and understood this entire agreement
- Read and understood our Health Guarantee
- Had the opportunity to ask questions and receive answers
- Agreed to all terms and conditions outlined herein
- Understood that this is a legally binding contract
